WELCOME TO THE WORLD OF UE MOBILE APPS!

When you use UE mobile apps, you provide certain information to us ('us' or 'we' being Ultimate Ears and Logitech).

We'd like to take this opportunity to explain how your information is collected, used, shared and protected on: smartphones and tablets; your UE speaker; and for UE apps and associated UE web pages.

Information, Collection and Submission

When you use UE apps and associated UE web pages, our servers may automatically receive, collect and record information regarding your use of the product, device or service, including:

• Event logging and sessions data by utilizing cookies, internet tags and analytics tracking pixels.
• The Internet protocol address (“IP address”) of your device and/or Media Access Control (MAC) address.
• The device type, the version number of the firmware or application you use, and other software, operating system or hardware information.

If you do not wish for us to collect the information above, we kindly ask you to discontinue use of all UE apps.

In-App Notifications

From time to time we like to share good news–like product updates, access to exclusive products, product use tips or special offers from UE. Don't worry, we won't be spamming you with ads from 3rd parties, but we do like to provide you with tools and offers to improve your experiences with our speakers.

These notices may be based upon your IP address collected by us or by third party service providers or may be based on application-specific information, like which version of the app or product firmware you are running. If you do not wish to receive these notices, you may switch them off from within the Settings section of the UE app.

INFORMATION USE

We use the information above to provide you with UE apps, associated UE web pages and in-app notices, and to enhance and improve our apps and products for you and other users.

Personal Information

We only use your personal information for the purpose that you provide it to us (e.g., technical support, special offers or notifications when you provided information for that purpose). We use this information to communicate with you either via the Internet, the UE apps or e-mail as may be applicable.

Use of non-Personal Information

We also use anonymous and aggregated data to create statistics and reports for various business purposes. We may aggregate anonymous data and share the anonymous data with our partners in order to improve our products, content and services.

E-Mail Messaging

We may ask for your email address to help provide you easier access to product or app updates. Except for service notifications, we will not send you promotional emails without your express permission. If you are receiving emails from us and decide at any time that you would like to stop delivery of these, simply follow the unsubscribe instructions contained in the email received. It should be noted that we may use tracking pixels to determine, in the aggregate, how many people open our e-mails.

Transfer and Information Storage

Most of the information we collect is stored on Logitech servers in the United States (or in any other countries in which Logitech or its corporate affiliates, subsidiaries or service providers maintain facilities). Some of this information is stored directly on your UE product, your device or computer and/or UE apps. By using UE apps you consent to the transfer and collection of information, as described in this Privacy Statement.

Retention of Information

We will retain collected information, as described in this Privacy Statement, for as long as needed. We will also retain and use such information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. Disclosure of Information

We absolutely do not sell or rent our customer or user information to unaffiliated companies. We disclose information you submit only as follows:

• We hire affiliated and unaffiliated service providers to provide the service to you including Logitech Inc., which is certified under the EU/CH-US Safe Harbor Program. For more information about Safe Harbor, visit the U.S. Department of Commerce’s Safe Harbor Web site regarding the collection, use, and retention of data from the European Union. All service providers are subject to strict confidentiality obligations and process your information only on our behalf and subject to our instructions. • We may share redacted or anonymized information freely, but only after we redact it to ensure that recipients cannot use the data to identify you or link the data to you.
• We may have to disclose information for purposes of protecting your or our legal rights or as required by law or orders from courts and government entities.
• We may disclose to another business entity should we plan to merge with or be acquired by that business entity; or to any organization involved in a merger, transfer, or sale of our assets or business.

Prohibited Disclosures

Except as set forth above, we will never disclose your personal information to any third party, including advertisers, without your explicit consent.

Protection of Information

We are committed to the protection of information collected, as described in this Privacy Statement. We use a variety of security technologies and procedures to help protect such information from unauthorized access, use or disclosure.

Changes to This Statement and Notices

To reiterate, when you use UE apps, you consent to the automatic collection and processing of your information as described in this Privacy Statement, as well as its other terms. If we update this Privacy Statement, we will post changes at www.UltimateEars.com. Your continued use of UE apps will constitute acceptance of the changes. Any translation of this Privacy Statement is done for local requirements or convenience, and in the event of a dispute between the English and any non-English version, the English version of this Privacy Statement will govern.
